If and to the extent that the Product is exported, taken with or used by
end customer or end user outside the EU any responsibility , warranty or
indemnicaon of manufacturer and its suppliers in regard to the Product expires
(including any indemnicaon in regard to infringement IPR).
8 Disclaimer
TCL Communicaon Ltd. will not be liable for any damages of any kind arising
out of or relang to the use or the inability to use the soware or any third
party applicaon, its content or funconality, including but not limited to
damages caused by or related to errors, omissions, interrupons, defects, delay
in operaon or transmission, computer virus, failure to connect, network charges,
in-app purchases, and all other direct, indirect, special, incidental, exemplary, or
consequenal damages even if TCL Communicaon Ltd. Has been advised of
the possibility of such damages. Some jurisdicons do not allow the exclusion
or limitaon of incidental or consequenal damages, so the above exclusions
or limitaons may not apply to you. Notwithstanding the foregoing, TCL
Communicaon Ltd. Total liability to you for all losses, damages, causes of acon,
including but not limited to those based on contract, tort, or otherwise, arising
out of your use of the soware or third party applicaons on this device, or any
other provision of this EULA, shall not exceed the amount you paid specically for
the Moveband applicaon or any such third party applicaon that was included
with this device. The foregoing limitaons, exclusions, and disclaimers shall apply
to the maximum extent permied by applicable law, even if any remedy fails its
essenal purpose.
There may be certain dierences between the user manual descripon and the
Moveband’s operaon, depending on the soware release of your device or
specic operator services.
