Duringtheabovetimeframe,SUNSTECHshallbeheldresponsibleforanylackofconformityofthe
productinrelationtothecontractinaccordancewiththeprovisionsoftheLawfortheProtectionof
ConsumersandUsers,thatshallentitletheconsumertorequesttherepairorreplacementoftheproduct,
unlessoneoftheseoptionsisobjectivelyimpossibleordisproportionate.
Accordingly,theremedy(i.e.therepairorreplacement)shallbedeemedtobedisproportionateifit
imposesunreasonablecostsontheseller.Inordertodeterminethis,thefollowingshallbeconsidered:(i)
thevalueoftheproductiftherewerenolackofconformity;(ii)therelevanceofthelackofconformity;
and(iii)iftheotherformofremedycouldbecarriedoutwithoutmajorinconveniencetotheconsumer
anduser.
To
determinewhetherthecostsareunreasonable,thecostsincurredbyoneformofremedymustbe
significantlyhigherthanthecostscorrespondingtotheotherformofremedy.
Inaddition,theconsumermaychoosebetweenrequestingareductioninthepriceorterminatingthe
contract,ifheisnotentitledtodemandtherepairorreplacementoftheproductandwheneverthese
actionswouldnotbecompletedwithinareasonabletimeframeandwouldcausemoreinconvenience
totheconsumeranduser.However,theterminationshallnottakeplacewherethelackofconformityis
minor.
Boththerepairandthereplacementoftheproductasresultoftheproduct

freeofchargefortheconsumeranduser,includinglabourandmaterials.

3.Conditionsforthewarrantytobeexercised
To
exercisethelegalandcommercialwarranty,itisnecessarytosubmitdocumentaryevidenceshowing
thedeliveryand/orpurchasedateoftheproduct,whethertheinvoice,receipt,deliverysliporsealedand
datedwarrantycard.Documentswhichhavebeentamperedwithorfalsifiedwillnotbeaccepted.
TheconsumershallcontactSUNSTECH

sCustomerServiceTeamusingthewebsite(underthesupport
section)andwillbeinformedaboutwhatactiontotake.Atthattime,theconsumershallhavetoprovide
acleardescriptionofthemalfunctionorthelackofconformityoftheproductwiththecontract.
Inanycase,repairsunderthewarrantyshallbecarriedoutbySUNSTECH

ServicesoritsauthorizeddistributorssothatSUNSTECHcanbeheldresponsibleunderthelegaland/or
commercialwarranty.
4.Exceptions
Thewarrantydoesnotforeseeorincludeperiodicmaintenanceorproductinstallationrevisions.
Inaddition,theproductwillnotbeconsideredaslackingconformityinrelationtothecontractand
therefore,itwillnotbecoveredbythelegalorcommercialwarrantywhen:
•Thelackofconformitycorrespondstoadiscrepancywiththesafetystandardsorthelocalornational
techniquesofadifferentcountrytotheoneitwasoriginallydesignedandproducedin;
•Thisproductoranyofitsidentificationfeatures(numberofseries,etc.)havebeenpartiallyor
