‐AtomixProductionsanditssuppliersretainallintellectualpropertyrightsinthesoftware.
‐Onceactivated,thesoftwarecannotberefunded,unlessfoundtobedefectivebyAtomixTechnicalSupport.

on‐lineforinstantdownloadthroughourwebsiteisconsideredopenedatthetimeofpurchase,andthereforenorefundcanbegiven.

1.PERMITTEDUSEANDRESTRICTIONS
Youaregrantedonelicenseto:
‐installandusetheSoftwareononecomputer.
‐installandusetheSoftwareonasecondcomputer,
ifthiscomputerisnormallyusedbythesamepersonandtheSoftwarewillnotbeusedonbothcomputersat
thesametime.
‐makeback‐upcopiesoftheSoftwareforarchivalpurposes.
ThislicensedoesNOTallowyouto:
‐rent,lease,sell,lend,distribute,publish,bundleorsublicense
theSoftwareoranypartofit.
‐rent,lease,sell,lendordistributehardwareonwhichtheSoftwareisinstalled,unlessspecificallyauthorizedbyAtomixProductions.
‐electronicallytransfertheSoftwarefromonecomputertoanotheroroveranetwork.
‐decompile,reverseengineer,disassemble,orotherwisereducetheSoftwareto
ahuman‐perceivableform.
‐modifytheSoftwareorcreatederivativeworksbasedupontheSoftware.
2.OWNERSHIP
TheforegoinglicensegivesyoulimitedrightstousetheSoftware.
Atomixanditssuppliersretainallright,titleandinterest,includingallcopyrights,inandtothe Softwareand allcopies
thereof.Allrightsnotspecificallygrantedin
thisEULA,includingInternationalCopyrights,arereservedbyAtomixanditssuppliers.
3.COPYRIGHTINFRINGEMENT
Unauthorizedcopying,distribution,modification,publicdisplay,orpublicperformanceofcopyrightedworksisaninfringementofthecopyrightholders'rights.Asa
conditiontoyouragreementwithAtomix,
youagreethatyouwillnotusetheSoftwaretoinfringetheintellectualpropertyrightsofothersinanyway.
4.WARRANTY
Atomixwarrantsthatthemedia,onwhichtheSoftwareisfurnished,ifany,willbefreefromdefectsinmaterialsandworkmanship.
Atomixoffersnowarrantyofperformance,
expressorimplied,withregardtothelicensedsoftwareandallaccompanyingmaterials.Atomixfurtherdisclaimsallother
warranties,expressorimplied,includingbutnotlimitedtotheimpliedwarrantiesofmerchantabilityandfitnessfora particularpurpose,withregardtothelicensed
softwareandallaccompanyingmaterials.
5.CUSTOMERREMEDY
Yourexclusiveremedyundertheabovelimitedwarrantyshallbe,atAtomixoption,eitherafullrefundofthepurchasepriceorcorrectionofthedefectivesoftware
ormedia.Noticeisherebygivenhowever,thatabsentanydefects,therewillbenorefundsissuedonactivatedsoftware.
6.DISCLAIMEROF
DAMAGES
Youassume responsibilityfor,among otherthings, (i) the selectionoftheLicensed Software toachieveyourintendedresults, (ii)the acquisitionofother software
(including any programming or operating system software) and/or equipment compatible with the Licensed Software, and (iii) the installation, use and results
obtainedfromthe
LicensedSoftware.Further, fortheexpresspurpose oflimitingthe liabilityagainstAtomix,youagree that,tothe maximumextentpermittedby
law, ATOMIX SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS,
BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR
ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE LICENSED
SOFTWARE, WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR OTHERWISE, REGARDLESS OF THE FORM OF ACTION, EVEN IF ATOMIX HAS
BEENADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES.
7.GENERALPROVISIONS
Thesoftwareisprotectedby
thecopyrightlawsoftheU.S.andothercountries.
Ifanypartofthisagreementisfoundtobeinvalidorunenforceable,theremainingtermswillstayineffect.
ThisagreementshallbegovernedbythelawsofthestateofDelaware,USA.
